INDIANA FRANCHISE LAWS
Franchise Registration in Indiana. Indiana franchise law provides that: “No person may offer or sell any franchise: (1) unless the franchise is registered under this chapter or is exempt from such registration . . . .” Indiana Code Section 23-2-2.5-9(1).
The initial franchise registration filing fee in Indiana is $500. Each annual renewal filing fee in Indiana is $250. The Indiana state franchise regulator’s web site is here.
Business Opportunity Exemption Registration in Indiana. There is no state business opportunity exemption registration required for franchises in Indiana. Indiana business opportunity law includes an exemption for franchises. Indiana Code 24-5-8-1.
Franchise Disclosure in Indiana. Indiana franchise law requires pre-sale disclosures to prospective franchisees similar to the requirements under the FTC Franchise Rule. Indiana Code Section 23-2-2.5-9(2).
Franchise Relationship Law in Indiana. The Indiana Deceptive Franchise Practices law includes restrictions and requirements for exclusive purchases from the franchisor, encroachment, modification of the franchise agreement, kickbacks, waivers, price increases, termination, non-renewal, non-competition covenants, limitations, marketing campaigns, coercion, failures to supply, succession following death, discrimination, and notice of termination and non-renewal. Indiana Code Sections 23-2-2.7-1 – 2.7-3.
